Through the in-depth analysis of two Netherlands Supreme Court decisions addressing structured finance cases, this article provides a lively picture of a key switch of the Netherlands tax system from an advance ruling environment to an environment in which the possibility of (also judicial) confrontation with the Revenue is to be taken into account by the taxpayer and assessed by the consultants.
