German Treaty Override Violates Constitutional Law

This article examines the recent decision of the German Bundesfinanzhof [Federal Tax Court], in which it was held that one of the German treaty-overriding practices violates international treaty law. The author also gives an overview of German treaty-overriding rules, followed by a discussion on their compliance with international treaty law.
