Another Italian Supreme Court Decision on the “Beneficial Ownership” Concept for the Purposes of the EU Parent-Subsidiary Directive (2011/96)

In this note, the authors discuss a recent decision of the Italian Supreme Court, which introduced a new “beneficial ownership” condition, allegedly derived from case law of the Court of Justice of the European Union, as a condition for the application of the EU Parent-Subsidiary Directive (2011/96).
