US Supreme Court Strikes Down Trump Tariffs
The US Supreme Court ruled on 20 February 2026 that President Donald Trump lacked the authority to unilaterally impose the sweeping global tariffs enacted under the International Emergency Economic Powers Act (IEEPA). The Court agreed with lower court rulings that the statute does not authorize the US President to impose acrosstheboard duties (seeLearning Resources, Inc. v. Trump, No. 241287 (U.S. Feb. 20, 2026)).

Chief Justice Roberts announced the Court's judgment with a majority opinion joined in full or in part by six Justices, accompanied by multiple concurrences from Justices Gorsuch, Barrett, Kagan, and Jackson, while Justices Thomas, Kavanaugh, and Alito dissented.
The IBFD will publish an indepth analysis of the ruling and its international tax and trade implications in the coming days.
