Terms of Use

These Terms of Use apply to all of IBFD’s websites (hereafter “the Site”) and form an agreement between IBFD and “the User” (being any visitor to the Site). IBFD may make changes to the content (including, without limitation, the web pages and published materials, hereafter “the Content”) and functionality on the Site, or to these Terms of Use, or discontinue the Site, at any time at its sole discretion.

By accessing or using the Site or downloading the Content, you accept all of IBFD’s terms and conditions, as outlined here and in IBFD’s General Terms and Conditions.

 

 

Permitted Use of the Site

The User is permitted to download one copy of any of the Content on the Site on a single device (e.g. a computer) for personal and non-commercial use, provided no changes are made to the Content and no copyright, trademark or other proprietary notices are removed. Any passwords used for the Site are for individual use only.

The Site and the Content may not be reproduced, stored, forwarded, used for resale or distribution, or be used for any other purpose, including, but not limited to, co-branding, framing or hyperlinking, without the express written permission of IBFD.

 

Links to Third Party Sites

Certain links on the Site will let you leave the Site. The linked sites are not under the control of IBFD, and IBFD is not responsible for the contents of any linked site, or for any content on any downstream websites, or for the privacy policies or Terms of Use of such sites, or for any changes or updates to such sites. IBFD provides these links to you only as a convenience, and the inclusion of any link does not imply endorsement by IBFD of the site or its contents.

Disclaimer

The Content on the Site is provided solely for informational purposes. Neither IBFD nor any other person is, in connection with the Site, engaged in rendering accounting, advisory, auditing, consulting, legal, tax or other professional services or advice.

The Site has been carefully compiled by IBFD, but no representation is made or warranty given (either express or implied) as to the completeness or accuracy of the information it contains, non-infringement, merchantability and fitness for a particular purpose. IBFD disclaims any and all liability for the acts, omissions and conduct of any third party in any IBFD services.

Limitation of Liability

IBFD, its affiliates, agents or suppliers are not liable to any person for any direct, indirect, consequential or other damages (including, but not limited to, any lost profits, loss of information or other data) that arise from the use of, or inability to use, the Content on the Site or on any linked website.

IBFD can be held liable for damages that are the result of an intentional act (opzet) or gross negligence (grove schuld) on the part of IBFD. In no event shall IBFD’s total liability exceed the price of the ordered product or a maximum of 50% (fifty per cent) of the licence fees paid in the preceding 12 (twelve) months.

Copyrights and Trademarks

Site and the products and services referred to on the Site are our trademarks, where applicable. All other trademarks belong to their respective owners. The Site and the Content are protected by Dutch and EU copyright laws and treaties.

Copyrighted material is marked with a copyright notice (“© name”); however, the absence of such a notice does not indicate the absence of copyright. Official documents included in IBFD’s collections, such as legal decisions, treaties and legislation, are free of copyrights. Documents prepared by IBFD itself, such as unofficial translations of treaty documents, are copyrighted by IBFD.

Whenever third-party copyrights are vested in publications included in IBFD’s collections, IBFD has been granted permission by the rightful copyright owners to include those copyrighted works in our databases. IBFD has cleared all intellectual property rights to its best endeavours and with utmost accuracy. Should you have a legitimate reason to claim copyrights on one or more of the individual publications in our database, please contact us.

Digital Rights Management

IBFD’s publications are protected by “Social DRM”. Each unique file contains both visible and invisible watermarks, which allow IBFD to monitor the number of times it is accessed or downloaded. In case of suspected misuse, IBFD has the right to terminate the User’s access immediately.

Official documents pertaining to legal decisions, treaties and legislation are not provided with Social DRM protection.

 

Governing Law and Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of the Netherlands. Any dispute that cannot be reconciled by discussion between IBFD and the User shall be submitted to the exclusive jurisdiction of the District Court in Amsterdam, the Netherlands.
